Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of Pocket Reserver, operated by Pocket Reserver, Inc. ("we," "our," or "us"). By creating an account or using any part of the platform, you agree to be bound by these Terms. If you do not agree, do not use Pocket Reserver.
The Platform
Pocket Reserver is a booking platform that enables service-based businesses ("Business Owners") to manage appointments, accept payments, and communicate with clients. Clients ("Clients") can discover businesses, book services, and manage their appointments. Pocket Reserver provides the technology platform only — we are not a party to the service agreements between Business Owners and Clients, and we do not employ or control the service providers listed on the platform.
Accounts
Eligibility
You must be at least 18 years old to create an account. By creating an account, you represent that all information you provide is accurate and that you have the authority to agree to these Terms.
Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
One account per person
Each person may maintain one account. Business Owners may maintain one business account per business entity. We reserve the right to merge or terminate duplicate accounts.
Business Owner Terms
Accurate information
Business Owners must provide accurate information about their services, pricing, availability, and cancellation policies. Misleading listings are grounds for account termination.
Stripe Connect
To accept payments through Pocket Reserver, Business Owners must connect a Stripe account and agree to Stripe's Connected Account Agreement. Pocket Reserver is not responsible for payment disputes, chargebacks, or Stripe account issues.
Subscriptions
Access to certain Business Owner features requires an active paid subscription. Subscriptions are billed monthly and renew automatically. You may cancel at any time; your access continues until the end of the current billing period. No refunds are issued for partial months.
Cancellation policies
Business Owners are responsible for setting clear cancellation and no-show policies. Pocket Reserver may display these policies to Clients but is not responsible for enforcing them or resolving related disputes.
Client Terms
Bookings
When you book an appointment, you enter into a direct agreement with the Business Owner. Pocket Reserver is not a party to that agreement. You are responsible for reviewing the business's cancellation policy before booking.
Payments
Payments are processed securely by Stripe. By providing payment information, you authorize Pocket Reserver and the Business Owner to charge your payment method for the agreed service amount. Deposits may be required and are subject to the business's individual policy.
Cancellations and refunds
Refund eligibility is determined by the individual Business Owner's cancellation policy, which is displayed at the time of booking and confirmed in your booking confirmation email. Pocket Reserver does not issue refunds on behalf of businesses.
Reviews
Reviews must be honest and based on your genuine experience. We reserve the right to remove reviews that are fraudulent, abusive, or violate these Terms.
Prohibited Conduct
You agree not to:
- Use the platform for any unlawful purpose
- Post false, misleading, or defamatory content
- Harass, threaten, or abuse other users
- Attempt to gain unauthorized access to any part of the platform
- Use automated tools to scrape, crawl, or mass-query the platform
- Impersonate another person or business
- Circumvent any payment, booking, or security system
- Use the platform to send spam or unsolicited communications
Violations may result in immediate account suspension or termination.
Intellectual Property
The Pocket Reserver name, logo, and platform software are owned by Pocket Reserver, Inc. and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the platform without our written permission. Content you submit (reviews, messages, business descriptions) remains yours — by submitting it, you grant us a non-exclusive license to display it on the platform.
Disclaimers
Pocket Reserver is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We make no representations about the quality, safety, or suitability of any services offered by businesses on the platform — use your own judgment and exercise appropriate care.
Limitation of Liability
To the fullest extent permitted by law, Pocket Reserver, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the platform shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.
Indemnification
You agree to indemnify and hold harmless Pocket Reserver, Inc., its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the platform, your violation of these Terms, or your violation of any third party's rights.
Termination
We may suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or conduct that harms other users or the platform. You may delete your account at any time. Upon termination, your right to use the platform ceases immediately. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will do so.
Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction in those courts.
Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 14 days before they take effect. Your continued use of Pocket Reserver after the effective date constitutes acceptance of the updated Terms.
